SECTION 9- DIGITAL PRIVACY AND COOKIES POLICY

You may interact with us in a variety of ways online, including through a mobile device. Information that we may collect about you through online interaction includes information that you input, such as your name, address, email address, other contact information; data resulting from your activity, such as transaction information; and location information. We may also gather additional information, such as the type of device and browser you are using, the IP address of your device, information about your device’s operating system, and additional information associated with your device. We may also gather information collected through cookies, tags, and other technologies, as described further below.

Cookies are pieces of data stored on your device. Browser cookies are assigned by a web server to the browser on your device. When you return to a site you have visited before, your browser gives this data back to the server. Mobile applications may also use cookies.

We use cookies and information gathered through their use to make your experience with Camps with Friends and certain other sites richer and more personalized based on the products, services, or other interaction you have with us and other sites. Information gathered through use of cookies may be used to make offers to you via online ads, email, U.S. mail, or telephone, subject to the privacy preferences you have on file with Camps with Friends. We also use cookies in conjunction with service providers, in online advertising either on the Site or on third party sites to help determine which of our advertisements (if any) are most likely to appeal to you.

Other parties that may collect information about your web browsing behavior when you use our Site/Application are generally limited to service providers who may only use any information collected to provide services and marketing for us and not to provide services or advertising for any other party. Note, however, that we may also provide certain widgets or tools on our sites, such as tools that allow web surfers to easily share information on another platform, such as a social media platform. At other times, information from a third party may be embedded on our site, such as a map or information streaming from another site, including communications streaming from a third party social media platform. These widgets, tools, and informational items often function through the use of third party cookies utilized by the third party site, such as the social media platform. As a result, these third parties may have access to information about your web browsing on the pages of our Site where these widgets, tools, or information are placed. You may wish to review information at third party sites, such as social media platforms where you have an account, to determine how these third parties treat data that they obtain through the use of cookies.

We also use cookies for purposes such as maintaining continuity during an online session; gathering data about the use of our site; monitoring online promotions; and anti-fraud and information security purposes. You may be able to set your browser to reject browser cookies. However, if you choose to reject cookies, you may not be able to access certain portions of the Site/Application. Therefore, if you set your browser options to disallow cookies, you may limit the functionality we can provide when you visit our Site. The latest versions of internet browsers provide cookie management tools, such as the ability to delete or reject cookies. We recommend that you refer to information supplied by browser providers for more specific information, including how to use these tools.

Cookies is a term also used to describe other locally stored objects, such as cookies stored in an Adobe folder on your device. These cookies will not be deleted when you clear cookies from your browser. We may use this technology for purposes such as information security and fraud prevention. In addition to the uses described above, we use information for purposes as allowed by law such as: servicing; communicating with you; improving our Site, products, or services; legal compliance; risk control; information security; anti-fraud purposes; marketing or personalizing the presentation of our products and services to you; tracking website usage, such as number of hits, pages visited, and the length of user sessions in order to evaluate the usefulness of our sites; and using read-receipt notifications in our email communications. We may share information with service providers with whom we work, such as data processors and companies that help us market products and services to you. When permitted or required by law, we may share information with additional third parties for purposes including response to legal process. As applicable, please see the additional privacy policies referenced above, such as the Camps with Friends Privacy Policy, for more information on how we may share information with affiliates and third parties.

Some newer browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the websites you visit indicating that you do not wish to be tracked. Those sites, including third-party content on such sites may continue to engage in activities you might view as tracking even though you have expressed this preference, depending on the sites’ privacy practices.

SECTION 10 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITYS

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Camps with Friends, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 11 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Camps with Friends and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 12 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 13 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our Site/Application.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 14 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this Site/Application or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 15 - GOVERNING LAW AND VENUE

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas without regard to any conflict of law provisions. You agree to the personal and exclusive jurisdiction of the courts serving Dallas, Texas. You hereby consent to the exclusive jurisdiction and venue of the State and Federal courts in Texas in all disputes arising out of or relating to these Terms of Service, our sites and site information.

SECTION 16 – ASSOCIATE CAMPS

Associate Camps refers to third-party entities who host camps and who are listed or featured on the Site and/or Application. The Associate Camps, by registering with the Site and/or the Application, agree to the Terms of Service as well as the Privacy Policy.

Associate Camps hereby grant Camps with Friends the right to use its trademarks, and any marketing material provided by the Associate Camps on the Site and Application.

WHAT INFORMATION DO WE COLLECT?

When you visit our website, the web hosting server recognizes your navigational information, including non-personally identifiable information (i.e. domain type, browser version, service provider and IP address), but not your name, email address, phone number or other personal details. This information is shared with third party services, such as Google or associated Camps, to allow Camps with Friends to gather broad information about visitors and their browsing patterns on the Camps with Friends website. Camps with Friends also collects information volunteered by visitors.

Customers and visitors to the Camps with Friends website may also submit their information voluntarily to be included on an email and/or physical mailing address list or for comments or questions about our services. We do not sell or rent our visitor or customer email addresses or make them available to other organizations for marketing purposes.

WHY DO WE COLLECT YOUR PERSONALLY IDENTIFIABLE INFORMATION?

The navigational information we collect tells us about the use of our website by visitors, including the areas of our site that are most visited or the time of a last visit to a page on our website. The navigational information helps us better understand a visitor’s experience and improve upon that experience by recognizing and delivering more of the features and services our visitors prefer. The information we collect is also used to improve the content of our website, to notify visitors who request specific information about updates to our website, and to contact visitors (with permission) for our own marketing purposes. The information we collect may be disclosed if we are legally required to do so at the request of governmental authorities conducting an investigation, to verify or enforce compliance with the policies governing our website and applicable laws, or to protect against misuse or unauthorized use of our website.

We do not send unsolicited commercial email, otherwise known as “spam.” We do not sell or rent our visitor or customer email addresses or make them available to other organizations for marketing purposes.

WHO DO WE SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION WITH?

We will not share your personally identifiable information with third parties (aside from entities that perform services for us, such as sending email communications) unless you have “opted-in” to such sharing. This will allow us to share your information with associated Camps. We may disclose information you provide if required to do so by law or if we have a good faith belief that disclosure is necessary to (1) comply with the law or with legal process served on us; (2) protect and defend our rights or property; or (3) act in an emergency to protect someone’s safety.

WHAT ABOUT PERSONALLY IDENTIFIABLE INFORMATION OF MINORS?

Our site is not directed to children under the age of 18. We respect the privacy of parents and children and are committed to complying with the Children’s Online Privacy Protection Act (“COPPA”). Camps with Friends does not control, operate or endorse in any respect information, products or services on such third-party sites and are not responsible for their content. Many third-party sites have their own privacy policies that differ from ours. This Privacy Policy only covers our site and does not cover any other site. While we make every effort to keep your information secure, we do not control the policies of other sites.
